c. Any other terms, conditions, notices or disclaimers displayed on individual pages of the The Big Smoke Media Group or The Big Smoke website,

c. Not use The Big Smoke website that causes us loss or damage in any way.
You agree to indemnify, defend and hold harmless Thebigsmoke.com.au, Big Smoke Media Group Pty Ltd, affiliates, employees, agents, third party information providers, service providers, licensors or the like and their respective officers, directors, employees, agents, licensors, representatives, and third party providers to thebigsmoke.com.au from and against all losses, injuries, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms and Conditions by you.
We take pride in our work and always use reasonable care and skill in providing The Big Smoke website. However, we cannot promise that The Big Smoke will be continuously available or virus/fault free. We do not represent or warrant that the content on The Big Smoke website (including third party content) is accurate, reliable, suitable, complete or of a particular quality.
Opinions expressed on The Big Smoke do not necessarily align with the opinions of the The Big Smoke Media Group Pty Ltd. The Big Smoke reserves the right to remove posts or links if they break the terms of usage in particular but not limited to:
• Comments inciting hate or violence
• Use of offensive language or content including harassing others
• Advertising third party services or websites unless agreed to in writing by the The Big Smoke Media Group.
• Abuse of the service provided by The Big Smoke Media Group Pty Ltd.
Furthermore, we retain the right to take ownership of any comments for the purpose of promotional or editorial usage and may edit these comments.
You grant to us a non-exclusive, irrevocable, perpetual, worldwide, royalty free, transferable licence to use, reproduce, modify, adapt, publish or communicate to the public your comments or activity in connection with The Big Smoke website and for the reasonable purposes of our business (including marketing) and the right to sub-license these rights.
Your activity on TBS must not;
a) be illegal or unlawful or cause a breach of law, code or an instrument which governs your conduct and/or our conduct;
b) be pornographic, sexually explicit, violent or obscene;
c) request personal information from a person who is under 18 years of age;
d) racist or hateful or promote racism or hatred towards another person or group of persons;
e) be threatening, abusive or harassing of another person or group of persons;
f) infringe any person’s intellectual property rights, including copyright or trade mark rights;
g) be malicious, defamatory or vilify;
h) be misleading or deceptive;
i) adversely affect or prejudice our reputation or brand;
j) transmit malware, viruses or other harmful computer code; or
k) send a commercial advertisement, an affiliate link or constitute any other form of solicitation to users of the service to buy or sell goods or services.
While we are not obliged to do so, we may monitor any content and/or commentary posted on the TBS website at any time.
• refuse to publish your content, article or comment;
• take down your content;
• report your activity to relevant authorities; and/or
• take any other action we consider necessary to remedy the situation.
Posting comments that repeatedly violate the moderation policy may result in your account being banned from The Big Smoke.

The Big Smoke Media Group prides itself on its client service, and its ability to deliver real business outcomes for its clients. Over the years, we have come up with some basic frameworks and processes that help ensure we partner best with our clients.
Scope changes:- This statement of work will outline a clear approach to our engagement with you. There may be times where this scope changes or is defined as part of the project. TBS+ offers as much flexibility as possible to allow our clients to best leverage our skills across different areas and in different channels, but we will still need to ensure the overall scope of deliverables, or expertise applied, is in line with this agreement and your account manager will raise issues of scope with you if the work requested exceeds that allowed for in this agreement.
Rounds of amends for creative work:– banners, articles, copy for websites, social media posts etc – Our costings are based on producing the work, having a review, doing revisions, and then the work going ahead. We are happy for clients to have 2 rounds of amends on work, but anything over that may need to be charged for – however, your account manager will raise this with you before anything is billed.
Past Performance Disclaimer
The Big Smoke Media Group endeavours to add value to all its client engagements, so if you feel you’re not getting what you want from your team, please get in touch with our management team to talk it through. All The Big Smoke Media Group contracts can be terminated with 30 days’ notice, which needs to be provided to email@example.com via email. No refunds will be offered on any services rendered, however we will try to make you as happy as possible.

The digital strategy and broad themes discussed herein may be inappropriate for business owners depending on their specific objectives and financial situation.
